Scope and definitions
These terms apply to all purchases from Fotoalsgemälde.ch. Personalised products means products made from your image and to your wishes - for example, a hand-painted painting from a photo.
Order confirmation
Once you have completed your order, you will receive an order confirmation by email.
Production and delivery
The expected delivery time is 2-3 weeks from the order date. Your painting is hand-painted by our artist. Before dispatch you will receive a photo of the painting for your approval, and you can request corrections. The painting is then framed and quality-checked, carefully packed and sent to your delivery address.
We deliver throughout Switzerland by insured, trackable parcel delivery (DHL/UPS) right to your door, and you will receive a tracking number.
Shipping
Free shipping throughout Switzerland - insured, trackable parcel delivery (DHL/UPS) right to your door; delivery takes 2-4 working days from dispatch. Your painting is delivered duty paid (DDP), with customs and VAT already settled - no extra charges on delivery. While the parcel is with the carrier, we follow it and help you if anything goes wrong.
Payment
You can pay with Visa, Mastercard, American Express, Apple Pay, Google Pay and PayPal. Because your painting is made to order and production begins immediately after you place your order, the amount is charged when the order is placed. All prices are in Swiss francs (CHF) and include 8.1 % VAT.
Right of withdrawal and 30-day satisfaction guarantee
As the goods are made to the customer's specifications, there is no statutory right of withdrawal under Swiss law (Code of Obligations, OR) - our 30-day satisfaction guarantee applies instead. This applies to hand-painted paintings made from your own photographs, which are clearly personal in nature.
Instead, we voluntarily offer a 30-day satisfaction guarantee on all hand-painted paintings. If you are not satisfied, you can choose:
- Free repaint - we repaint the painting at no charge. You send the original painting back to us at your own expense.
- Full refund - you send the painting back at your own expense, and the full amount for the painting and frame is refunded once we have received it undamaged.
The painting must be carefully packed, and it must be returned within 30 days of receipt. Please contact us at hallo@fotoalsgemaelde.ch or +45 26 44 38 44. The guarantee is in addition to your statutory rights and does not limit them.
Warranty
You have a 2-year warranty under Swiss law (Art. 210 CO). This means you can report faults and defects in the painting or the frame that were already present at delivery, even if they only become apparent later. The warranty does not cover damage caused by improper handling or normal wear and tear after delivery. You must report a defect within a reasonable time after discovering it - a report within 2 months is always considered timely. We cover reasonable shipping costs for a justified warranty claim.
Use of images in marketing
Fotoalsgemälde.ch may show images of your finished painting on our website and in our marketing as an example of what can be made. You can object to this at any time, and we will comply with your request immediately.
Privacy and cookies
We only process the information needed to complete your purchase and deliver your order. Please read our full privacy policy. We use cookies for operation, statistics and marketing. On your first visit you choose in the cookie banner which categories you wish to accept, and you can change or withdraw your consent at any time.
Force majeure
In the event of war, natural disasters, industrial disputes, orders from public authorities, failed deliveries from subcontractors or other extraordinary circumstances beyond the control of Fotoalsgemälde.ch, Fotoalsgemälde.ch cannot be held liable for failure to meet the above terms.
Liability and governing law
Fotoalsgemälde.ch is liable in accordance with the general rules of the Swiss Code of Obligations (OR). Every purchase is governed by Swiss law.

If we cannot find a solution, please contact the Swiss consumer ombudsman (Ombudsstelle Konsumentenschutz, konsumentenschutz.ch); the place of jurisdiction is Aarhus, Denmark, where legally permissible.
